Liability In Semi-Truck Accidents
When a truck driver for a California company is injured their family will typically be able to receive benefits from worker’s compensation. In addition to any worker’s compensation claims, the family of a deceased truck driver may be able to pursue a third party negligence claim against any other companies responsible for the accident. This may include the negligence of another truck driver.
Truck drivers are held to a very high standard when it comes to operating their vehicle safely. They need to undergo training and periodic medical reviews to make sure that they are fit to drive. When one truck rear-ends another vehicle that is typically very strong evidence that the first driver was not paying attention or following the lead vehicle too closely. Drivers are expected to maintain a safe distance with the vehicle in front of them in order to avoid accidents.
A deceased driver’s next of kin can seek justice through a wrongful death claim. Damages may include compensation for economic and non-economic losses. A truck accident attorney can evaluate all of the specific facts of your case and let you know what your rights are. Most trucks are equipped with event-data-recorders (EDRs) that monitor what a truck driver was doing right before an accident. An attorney can request files from the EDR to give victims a better understanding of what happened.
