Liability In Roofing Accidents

Construction sites can be extremely dangerous even for experienced workers. In any given year there are over 150,000 construction related accidents. OSHA has identified the “fatal four” types of accidents that account for most injuries in deaths.

  • Falls are the leading cause of injury and deaths at work sites. In order to keep employees safe employers should include safety harnesses and lines when required.
  • Being struck by falling objects is the second leading cause of injury and death for workers. Workers can help stay safe by wearing hard hats and never positioning themselves under a suspended load.
  • Electrocutions are responsible for more than 300 deaths and 4,000 injuries every year. Adequate training and  personal protective equipment (PPE) can go a long way towards protecting workers.
  • Caught-in-between accidents occur when a worker is crushed between two or more objects. This most often occurs when trucks or other heavy equipment are backing up. It’s important that employees communicate with one another to prevent these types of accidents.

The family of a worker that died in an accident at work is protected by a  number of laws. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This includes death benefits to a worker’s next of kin or other dependents.

In addition to worker’s compensation claims the family of an injured worker may be able to pursue a third party liability claim. For example, if a property owner had their premises in an unsafe condition they could potentially face civil liability following an accident.  A premises liability attorney can examine all of the facts of your case and let you know what your options are.
