Two People Were Injured In Oceanside Car Accident  After Man Drove Into Villa Trieste Senior Clubhouse

OCEANSIDE, CALIFORNIA (April 17, 2019) – Two people were injured in a car accident at the Villa Trieste Senior Clubhouse after an elderly man drove into the building.

Oceanside police are saying that the accident took place on Tuesday around 5:20 p.m. at the senior community by Rancho Del Oro Drive west of MiraCosta College. A man in his 80’s was driving a Toyota Matrix and mistook the accelerator for the brakes.

He crashed into the senior clubhouse and struck two women that were inside. Both of the women had to be taken to the hospital in order to receive treatment. One woman sustained a serious leg injury.

The man who drove into the Villa Trieste Senior Clubhouse was not injured in the crash.

Liability in Car Into Building Accidents

According to the Storefront Safety Council, cars driving into buildings is actually remarkably common. Between the year 2014-2019 there were more than 21,000 instances of cars driving into storefronts. The top three causes of these accidents are as follows:

  • DUI
  • Pedal error
  • Operator error

Elderly drivers, in particular, are much more likely to experience “pedal confusion” prior to an accident. In short, during pedal confusion drivers mistake the brakes for the accelerator. Though these accidents may seem completely random there are actually safety measures that can be put in place to help reduce them.

For example, bollard posts can prevent a large number of car into building accidents. Bollard posts are rigid metal or concrete pillars put in areas where cars travel to prevent them from going to certain places. These posts are most often installed in front of stores to prevent errant drivers from striking pedestrians.

Property owners could face civil liability for a car into building accident under e California Civil Code § 1714 subsection (a). Victims may be able to recover damages for lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your options are.
