Liability In Drowning Accidents

All companies have a legal responsibility to maintain their premises in a reasonably safe manner. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”

This is especially important for spas and other athletic clubs that have swimming pools. It’s important that children are properly supervised and that measures are put in place to make sure that drownings don’t take place.

  • Gate guards can be used to monitor the flow of children in and out of the pool area.
  • Lifeguards should be positioned at both ends of the pool.
  • Lifeguards must be alert and not distracted by their cellphones.
  • Lifeguards must be properly trained in CPR. This can often mean the difference between life and death.

Even if a child survives in a near-drowning they can often be left with a number of very serious health consequences. Here are just a few of the injuries that can occur in a near drowning accident according to drugs.com:

  • Acute respiratory distress syndrome (ARDS): This is a very serious condition that may lead to respiratory failure down the line.
  • Brain Edema: This may occur when there is brain cell damage caused by a lack of oxygen to the brain over a long period.
  • Pneumonia: This is a lung infection that can occur after a near-drowning.

The family of any child that is injured in a near-drowning accident may have legal recourse through a bodily injury claim. Damages in a civil claim can include money for medical bills, lost wages and pain and suffering. It’s important that victim’s of near-drowning accidents get regular follow-up care. A premises liability attorney can examine all of the facts of your case free of cost and let you know what your legal rights are.
