Liability In Box Truck Accidents

Flat tires are extraordinarily common in the United States. It has been estimated that there are around 220 million flat tires every year. This works out to around 7 flat tires every second. Getting a flat tire on the freeway can be extremely dangerous. Drivers have a responsibility to scan ahead and drive according to the prevailing conditions.

According to the California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

Rear-end collisions should not take place if a driver is being careful. Drivers are supposed to maintain a safe distance with the vehicle ahead of them if they slow down or stop abruptly. In many situations, a driver that rear-ends another vehicle is presumed to be at fault. A rear-end collision with a truck can be particularly devastating and result in serious injuries. A few of the common causes of rear-end collisions include

  • Speeding
  • Distracted driving
  • Road rage
  • Mechanical failure
  • Fatigued driving

Fatigue, in particular, is the number one factor associated with commercial truck accidents. Victims are able to recover damages for lost wages, medical bills and pain and suffering. Many victims may not even fully realize the full extent of their injuries until many months or years following a collision. For example, post-traumatic stress disorder is fairly common following commercial truck accidents. A truck accident attorney can investigate your claim free of cost and let you know what your legal options are.
