NORTH HOLLYWOOD, CALIFORNIA (June 12, 2019) – A city worker identified as Fredy Vanegas has tragically died in an accident on Tujunga Avenue by Oxnard Street.

Los Angeles police are saying that Fredy Vanegas fell from a tow truck. The city’s rapid response rushed to the area in order to help the victim.

The fall happened around 3:25 p.m. and remains under investigation. Cal/OSHA are saying anyone that may have seen the accident that killed Fredy Vanegas should reach out to them.

Common Workplace Accidents

Over 5,000 workers are killed every year on the job in the United States. Nearly 60% of all fatal accident fall under 1 of 4 categories that OSHA has labeled the “fatal four.” Here are the fatal four from most least deadly:

  • Falls (39.2% of all fatalities)
  • Struck by objects (8.2% of all fatalities)
  • Electrocutions (7.3% of all fatalities)
  • Caught-in/between (5.1% of all fatalities)

In short, workers are much more likely to be injured or killed in falls than pretty much anything else. There are a number of steps that can be taken to help prevent falls. For example, workers should typically be given fall arrest systems when they work from elevated positions. These are specifically designed to catch workers in case they fall. Depending on the facts of any case, a worker’s family may have multiple forms of relief following an accident.

Liability In Workplace Accidents

Cities have a legal responsibility to take steps to prevent their workers from being injured. In the event of an accident, a city must provide the family members of the deceased worker with death benefits. Workers are barred by statute from bringing claims directly against their employer.

However, if a worker was injured in an accident they may be able to file a claim against a third party entity responsible for the accident. For example, if a machine or truck malfunctioned and caused a worker to fall the company that manufactured the truck could bear civil liability. It’s important to make sure that evidence is preserved after an accident.

A wrongful death attorney can examine all of the facts of your case free of cost and let you know what your legal options are. An attorney can see if there are any potential sources of third party negligence. Damages in a civil claim may include compensation for lost wages, medical bills, pain and suffering, loss of love and emotional trauma.
