Pedestrian Killed In Newport Beach Car Accident By East Coast Highway And Reef Point Drive

NEWPORT BEACH, CALIFORNIA (August 1, 2019) – A pedestrian has tragically died in a car accident that took place on East Coast Highway and Reef Point Drive.

California Highway Patrol are saying that the accident happened around 10:00 p.m. not far from the entrance of Crystal Cove State Park.

The pedestrian was hit by an on-duty state park truck. Paramedics responded to the scene of the accident in order to help the victim. It remains unclear if the driver of the truck will be cited for the accident.

An investigation remains ongoing at this time.

Liability In Pedestrian Accidents

All drivers must exercise caution in order to avoid hitting pedestrians. This is true even if a pedestrian is outside of a lawfully marked crosswalk. According to California Vehicle Code 21950, “The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.”

The family of any victim that died in a pedestrian accident may be able to seek justice through a wrongful death claim. If the negligent driver was working at the time of the accident the company that they work for may face civil liability as well.
