Liability In Pedestrian Accidents
Drivers are expected to obey the rules of the road and take steps to avoid hitting pedestrians. A driver may be negligent if they were speeding or distracted before an accident occurred. When police conduct an investigation into an accident they consider a whole range of evidence including potential video footage and tire marks. Tire marks in the roadway are an indicator that a driver attempted to brake before an accident. When a driver is distracted there will often be no tire marks. A victim or their family may have the ability to file a personal injury claim for damages.
