What To Do After A Motorcycle Accident
Motorcycle accidents can be absolutely devastating for a victim and their family. Even when a victim is wearing a helmet and protection, the risk of serious injury is fairly high with an accident. Victims of motorcycle accidents can take a number of steps to make sure that their rights are being protected:
Seek medical attention following a crash. It’s important to get your injuries documented.
Take photographs of the scene of the collision.
Document any wages that you lost.
Don’t speak with the insurance provider of the at-fault party.
Seek an attorney that specializes in your type of claim.
A motorcycle accident attorney can take steps to make sure that you are properly compensated after an accident. Victim’s may be able to seek damages for lost wages, medical bills and pain and suffering.
Liability In Left Turn Car Accidents
Depending on the facts of the case, Frank Toyota may face civil liability for the tragic death of Andrew Balderas. Car dealerships often drive their vehicles around to get them repaired or to shuttle customers. If an employee of a car dealership acts negligently and causes a car accident the company that they work for may face vicarious liability. A common mistake that is often lethal for motorcyclists are dangerous or illegal left turns. Unless a driver has a green arrow they will typically be held at fault for an accident if they were the ones making a left turn. In short, cars attempting to make left turns are supposed to yield the right of way to oncoming vehicles.
According to the California Vehicle Code Section 21804(a), “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic, as defined in Section 620, approaching on the highway close enough to constitute an immediate hazard, and shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.” A personal injury attorney can examine the specific facts of your case and let you know if you have a claim that can be pursued.
