According to a spokesperson for Cal/OSHA, there is currently an investigation into how the accident with the mechanical grape picker took place.
Liability In Accidents With Mechanical Grape Pickers
Grapes are a major cash crop for California. In fact, California exports about 90% of all of the grapes grown in the United States. But there are a number of unique hazards associated with harvesting. Most grapes are harvested with enormous machines called grape pickers.
These machines have large openings in order to suck in grapes and sort them. A number of accidents happen when they tip over or when a worker becomes ensnared. A number of other workers get run over.
When a worker is injured or killed in California they or their family will typically be able to recover damages by filing a workers compensation claim. Depending on the facts of any case a worker may also be able to pursue a third party negligence claim. For example, if a grape picker malfunctions and injures or kills a worker the company that built the machine may face civil liability. A wrongful death attorney can evaluate the specific facts of your case and let you know what your rights are.
