Casilina Gallagher Accident: 33-Year-Old Casilina Gallagher Died In Montecito Train Accident By The Olive Mill Road Off-ramp

MONTECITO, CALIFORNIA (November 19, 2018) A 33-year-old woman identified as Casilina Gallagher has tragically died in a train accident on Olive Mill Road near a curve in the tracks.

Montecito police are saying that the victim was hit by a passenger train around 7:10 a.m. The engineer saw the woman on the tracks and sounded the horn. But the train was not able to stop in time and hit the woman.

Paramedics rushed to the scene in order to help the victim. But Casilina Gallagher was later pronounced dead due to her injuries.

The train accident took place as the passenger train was coming around a curve. There is an active investigation into how the accident took place.

Liability In Train Accidents

There are a number of entities that could face liability for the train accident that killed Casilina Gallagher. Far too often, pedestrians are immediately blamed when they are killed or injured in a train accident. But a number of factors may make a train accident more likely. For example, a railroad company or city may be liable for a train accident if it was caused by issues with visibility or line of sight.

Trains always have the right of way and drivers as well as pedestrians should yield to them. However, for this to happen a driver or pedestrian must be properly informed of an oncoming train. This entails that pedestrians and drivers have an adequate line of sight to oncoming trains. Here are just a few of the ways that line of sight at a railroad section can be interrupted.

  • Foliage or buildings can obscure the line of sight at a railroad crossing. This is dangerous because a pedestrian or driver will not be able to see a speeding train coming towards them until it’s a few meters away.

  • The angle of the roadway can also create a hazardous situation. Sections of track that move along a curve create a blind spot for pedestrians and drivers.

  • The incline of a road leading up to a rail crossing can create problems with a line of sight as well.

Even if a person deliberately puts themselves on a set of train tracks, this doesn’t remove a train operators duty to keep a watchful eye of the tracks. The family of a person that died in a train accident may be able to pursue a claim for damages. It’s important to seek the advice of an experienced wrongful death attorney following a train accident. They can investigate your claim for free and let you know if there are any potential issues with line of sight at a railway crossing.
