Liability In Industrial Accidents
According to the Occupational Safety and Health Association (OSHA), there were 4,674 workplace fatalities in 2017 alone. The vast majority of these accidents fall under four broad categories. These “fatal four” accident types are listed below:
- Falls (39.2%)
- Struck By Object(s) (8.2%)
- Electrocutions (7.3%)
- Caught-in/between (5.1%)
Companies have a responsibility to crate a safe working environment for their employees. This includes giving them the proper training in order to avoid accidents. Regardless of fault in an accident, the family of a victim that dies will be able to receive death benefits through the worker’s compensation system. According to California’s Department of Industrial Relations:
“Death benefits are payments to a spouse, children or other dependents if an employee dies from a work-related injury or illness. This includes reasonable burial expenses, not exceeding $5,000 for injuries before Jan. 1, 2013 and $10,000 for injures on or after Jan. 1, 2013. The amount of the death benefit depends on the number of total and/or partial dependents.”
In addition to worker’s compensation the family of a deceased worker may be able to pursue a third party liability claim. A third party claim may be possible if a piece of machinery malfunctioned and contributed to an accident. A wrongful death attorney can examine the specific facts of your case and let you know what your options are.
