Liability In Accidents Involving DUI Drivers

Drivers that cause great bodily injury while under the influence may face felony criminal charges as well as civil claims. According to the California Vehicle Code Section 23152(a), “It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.”

The state of California does not differentiate between illegal drugs and prescription medications. There are a number of medications that can seriously impact a person’s ability to operate a motor vehicle safely. According to David B. Carr, MD, these will include:

  • PDI Medications

  • Drug-Related AEs

  • Benzodiazepines and Hypnotics

  • NSAIDs

  • Tramadol and Buprenorphine

It is the responsibility of every driver to check with their doctor to make sure that they can safely take their medications and drive. DUI accidents can cause serious injury and death, especially for pedestrians. Victims of pedestrian accidents – or their family – will typically have the ability to file a claim for damages including lost wages, medical bills and pain and suffering. A pedestrian accident attorney can investigate the specific facts of your claim and let you know what your rights are.
