MARIN, CALIFORNIA (September 18, 2019) – A 39-year-old mother and her two children were seriously injured in a car accident on Highway 101 near the St. Vincent exit.

California Highway Patrol are saying that the accident took place around 8:30 a.m. For reasons that remain under investigation a Toyota Forerunner lost control and traveled into opposing lanes of traffic.

The Toyota hit the car carrying the mother and her children causing the car to overturn and burst into flames. Good Samaritans were able to remove the woman and her two children from the car.

All three victims had to be taken to the hospital with critical injuries. The CHP is investigating if inclement weather may have contributed to the accident.

Liability In Car Accidents

All drivers have a legal responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid causing accidents. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” Head-on collisions tend to take place due to:

  • Speeding
  • Driver distraction
  • Inclement weather
  • Driver fatigue
  • Driver intoxication

Depending on the facts of any case a city or state could be held liable for a head on collision. States must create, design and maintain highway systems that are reasonably safe. A state may be liable if there were inadequate barriers between opposing lanes of the highway. A number of freeway medians consistent solely of flimsy wooded post guardrails. Concrete K-pillars are much more effective at preventing head-on collisions.

Any person that is injured in a head-on collision is protected by a number of laws. For example, victims are able to seek damages through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
