Liability In Chemical Accidents
Public and private universities in California have a responsibility to take measures to prevent accidents on their property. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes taking steps to protect students in science laboratories. There are number of safety measures that should be followed in science labs in order to help keep students safe.
- Students should arrive a their labs with long pants and covered shoes.
- Lab coats can provide a protective barrier from chemicals
- Safety googles are vital in labs. Even the fumes from certain chemicals can damage your eyes.
- Students should wear safety gloves.
When a University is negligent in taking steps to help keep students safe they may face civil liability in the event of an accident. Victims of chemical reaction accidents may have legal recourse through a bodily injury claim. Damages may include money for lost wages, medical bills and pain and suffering. A Los Angeles premises liability attorney can examine all of the facts of your case and let you know what your rights are. There are statute of limitations associated with being able to pursue a claim, so it’s important to act quickly.
