Liability In Hit-And-Run Collisions
It is a felony to flee the scene of an accident that causes bodily injury. According to the California Vehicle Code 20002, “The driver of any vehicle involved in an accident resulting only in damage to any property, including vehicles, shall immediately stop the vehicle at the nearest location that will not impede traffic or otherwise jeopardize the safety of other motorists.” Drivers that choose to flee the scene of an accident will likely face civil as well as criminal liability.
A number of hit-and-run collisions take place when drivers are intoxicated. According to Mother’s Against Drunk Driving (MADD), “In 2017, 9 percent of all drivers involved in fatal crashes during the day were drunk, compared to 32 percent at night. In addition, almost twice as many alcohol-related traffic fatalities occurred during the weekends compared to weekdays.” Victims of hit and run accidents may have legal recourse.
Any person that is injured in a car accident due to the negligence of another driver may be able to file a bodily injury claim for damages. For example, a victim may be able to recover damages for pain and suffering, lost wages and medical bills. A car accident attorney can fight on your behalf and work to get you the compensation that you deserve. It doesn’t cost anything to hire an attorney and they only get paid if the successfully resolve your case.
