California Highway Patrol are saying that the accident took place around 4:00 a.m. in the number 4 lanes of the 405 freeway. A 49-year-old truck driver was allegedly traveling at an unsafe speed when it collided with a disabled 2014 Dodge Journey containing Ronald Mullen and Chevette Pugh.

However, Ronald Mullen who was the drive of the 2014 Dodge Journey later died due to his injuries. The driver of the Kenworth truck remained at the scene to talk to police and was not arrested following the accident.
CHP investigators closed multiple lanes on the 405 freeway through the Sepulveda Pass as they continued to investigate.
Liability In Car Accidents Involving Dodge Journey SUVs
According to the Centers for Disease Control and Prevention, “Reducing motor vehicle crash deaths was one of the great public health achievements of the 20th century for the US. However, more than 32,000 people are killed and 2 million are injured each year from motor vehicle crashes. In 2013, the US crash death rate was more than twice the average of other high-income countries.”
Nearly 4,000 of those fatal accidents involve commercial trucks. For the most part truck drivers are safe. But around 20% of all fatal accidents involving commercial trucks involve truck driver error. Here are just a few of the reasons why truck accidents take place:
- Truck driver fatigue
- Adverse weather conditions
- Traveling too fast for conditions
- Driver intoxication
- Mechanical issues with the truck
Truck drivers have a legal obligation to operate their vehicle at a reasonable speed and according to the prevailing conditions. Many people mistake this for driving the speed limit. During times of reduced visibility or at night it’s best to slow down. A fully loaded semi-truck can weigh as much as 80,000 lbs. They can therefore be very difficult to stop. This is why it’s also critical for semi-trucks to maintain a safe follow distance with the vehicle ahead of them.
According to the California DMV, “To avoid tailgating, use the “3 second rule”: when the vehicle ahead of you passes a certain point, such as a sign, count “one-thousand-one, one-thousand- two, one-thousand-three.” This takes approximately 3 seconds. If you pass the same point before you finish counting, you are following too closely.” There is simply no reason why a truck should ever rear-end another vehicle. This is typically fairly strong evidence that the truck was traveling at an unsafe speed or following the lead vehicle too closely.
Liability for a rear-end collision may extend beyond the driver of a semi-truck. The manufacturer of a car may be liable for an accident if a car stalled in the middle of the road leaving its occupants in peril. Car companies have a legal responsibility to design and create products that are reasonably safe but this doesn’t always happen. For example, Chrysler has recalled thousands of Dodge Journey SUVs because they had faulty ignition switches which were causing vehicles to stall unpredictably. Thus far related accidents have led to over 104 injuries and 57 fatalities.
The family of any victim that died in a truck accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are. An attorney can also determine if a car manufacturer could be liable for an accident. There are, however, very strict statute of limitations associated with civil claims. It is therefore important to act quickly.
