How To Protect Your Rights After A Bus Accident

Buss accidents can leave victims with severe injuries and psychological trauma. Victims may wonder how they are going to pay for their medical bills. There are a number of steps that the average person can take to help protect their rights after an accident and maximize the value of their claim. Here are just a few things you should do if you’ve been involved in a bus accident:

  • Collect as much evidence as possible. Take photos of the accident scene and of any injuries that you sustain. Get the contact information of potential witnesses. The more thorough you are able to be the stronger your case will be.

  • Seek treatment as early as possible. Insurance companies will argue that you weren’t really injured if you don’t seek treatment or if there are large gaps in your treatment.

  • Don’t discuss your case with the bus company’s insurance provider.

  • Seek the legal counsel of an experienced Los Angeles bus accident attorney. An attorney can advocate for you after an accident and make sure that you are fairly compensated for your injuries.

Bus companies and their insurance providers work hard to deny liability after an accident. Even if they admit fault, it’s common for them to downplay the extent of your injuries. Don’t let an insurance company bully you into an unfair deal. There are laws designed to protect your rights and an attorney can make sure you are being taken care of.

Liability In The North Hills Bus Accident

Buses are common carriers under the law and bus drivers are held to a very high standard in terms of safety. A bus driver is considered negligent when their behavior deviates from that of a reasonable person under similar circumstances. So, for example, if a bus driver is drowsy and this causes them to lose control this is certainly negligence. Inattentiveness is a major problem for bus and truck drivers. These drivers often work long hours and may not get enough sleep. But drivers are not the only reason that accidents happen.

Mechanical issues with a bus contribute to thousands of accidents every year. Brake pads get worn out as do tires. Excessive wear on a tire can cause it to explode. This can cause a bus to veer to one side of the road. Crash scene investigators will look at the condition of a bus’ tires  and skid marks on the road in order to determine what happened. A number of buses and trucks also have event data recorders (EDR). These can help determine the speed of a bus and other conditions prior to a crash. Victims of bus accidents will typically have the ability to file a claim for damages including lost wages, medical bills and pain and suffering.
