Liability In Rear-End Collisions

Nearly 35,000 people die in car accidents every year across the United States. It is one of the leading causes of preventable death and injury. Every driver has a common law duty to operate their vehicle in a reasonably safe manner and take steps to avoid collisions. According to California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”

This is especially important at night when there is decreased visibility. Driving the speed limit during a time of decreased visibility. A good driver should be able to spot what’s ahead of them and slow down accordingly, even if the lead driver slows down abruptly. Admittedly, this can be difficult at night when the roads are pitch black. If your car stalls on the freeway, it’s best to put on your hazard lights and get clear of the area.
