Michelle Quessenberry told authorities that she had just left work when she saw another vehicle spin out and hit the center divider. She immediately went over to help the victims.
Another vehicle hit the car that had spun out. This threw the victim to the center divider before she was then run over. Michelle Quessenberry was transported to the Pomona Valley Hospital Medical Center in order to receive treatment for numerous injuries. These include:
- Pelvic Fractures
- Broken Ribs
- Broken Collar Bone
- Broken Arm
Her nurse coworkers set up a Go Fund Me campaign in order to help with her medical expenses. Those that know her hold her in the highest regard and are calling her a hero. Doctors are saying that the victim’s recovery could take months.
Liability In Car Accidents
Drivers have a responsibility to scan the road for dangers and to take steps to avoid causing accidents. According to the California Vehicle Code 22350, “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic on, and the surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.”
What many drivers don’t understand is that driving the speed limit during a rainstorm can be dangerous. Rain causes the roadways to become slick and may lead to hydroplaning. If a driver is negligent and causes an accident that injured another person, they may face civil liability for the crash. A city may even face liability for a car accident if there was a defect in the roadway.
According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” A car accident attorney can evaluate the specific facts of your case and let you know what your options are.
