Louis Otero Los Angeles: 78-Year-Old Homeless Man Identified As Louis Jude Otero Died In Hit-And-Run Tour Bus Accident In University Park By Flower Street and Adams Boulevard Not Far From Exposition Park
LOS ANGELES, CALIFORNIA (July 23, 2019) – A 78-year-old homeless man identified as Louis Jude Otero has tragically died in a tour bus accident chartered by Samho Tour & Travel after he was dragged several hundred feet by Exposition Park.
The fatal bus accident took place on January 10, in University Park at the corner of Flower Street and Adams Boulevard. One witness told the Los Angeles Police Department that the victim became lodged under the bus and was dragged over 900 feet.
Police suspect that the driver of the tour bus may not have realized what happened. He kept going and was later confronted in a storage yard in Gardena. Authorities are saying that the bus company responsible for hitting Louis Jude Otero is cooperating with the investigation.
There are new details that have come out about what may have caused the crash. Fatigue may have played a role since the driver of the charter bus was returning from a four day trip after traveling more than 2000 miles.
The Los Angeles Police Department released a photo of Louis Jude Otero in the hopes that they will be able to find his next of kin.
Liability In Tour Bus Accidents
There are a number of sources of potential negligence for the fatal tour bus accident that killed Louis Jude Otero. To begin with, tour bus companies are considered “common carriers” under the law. A “common carrier” is a company – either public or private – that offers transportation to the public in exchange for money. The drivers for a common carrier (including tour bus operators) are held to a very high standard when it comes to evaluating negligence following an accident.
According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].” When a bus driver hits someone and drags them any distance that is fairly strong evidence the driver was not paying attention and therefore negligent.
The family of a victim that died in a bus accident is able to seek justice by filing a claim under California’s Code of Civil Procedure 377.60. Damages in a wrongful death claim may include compensation for lost wages, lost companionship, funeral costs and pain and suffering. When a bus driver is negligent, the bus company that they work for may face vicarious liability as well. Companies are generally responsible for the negligence of their employees when those employees are working withing the course and scope of their job duties. A bus accident attorney can investigate all aspects of your case and let you know what your rights are.
