LOS ANGELES, CALIFORNIA (October 25, 2018) A civil engineer from Ireland identified as Liam ‘Doug’ O’Connell was critically injured after he was involved in a freak scooter accident while he was visiting Los Angeles.
Liam ‘Doug’ O’Connell had been living in Vancouver and was on Vacation in Los Angeles. At some point during his stay Liam ‘Doug’ O’Connell was riding a scooter on October 5 and involved in a serious accident.
The victim had to be rushed to the hospital where he received treatment for a traumatic brain injury and a fractured skull. Doctors had to perform an emergency decompressive craniectomy in order to help relieve brain swelling.
There has been an outpouring of support for the young engineer in order to help with his recovery. You can help the victim by donating to the Go Fund Me page that has been set up for him.
Family members are saying that Liam ‘Doug’ O’Connell has suffered numerous complications during his recovery including pneumonia. “Liam is a role model to his younger twin brothers Eoin and Gearoid, best friend to his older sister Caitríona, and loving son of Kathleen and Dave.” said Pal Cian O’Callaghan.
An investigation into the scooter accident remains ongoing at this time.
Safety Problems With Scooters
Companies like Lime and Bird supply a number of electric scooters across Los Angeles. These can be rented fairly cheaply and travel at speeds of up to 15 miles per hour. But there are a number of ways in which riding a scooter can be extremely hazardous.
Unlike bicycles, scooters have a very high center of gravity making it more likely that they will tip over. Their smaller wheels also gives them much less stability than bicycles.
Failing brakes on scooters have caused countless numbers of accidents. This can be especially treacherous for riders in LA who must regularly go downhill.
The throttle on these scooters often sticks leaving riders in peril. Being safe while riding through traffic requires a rider to be able to alternate their speed. But a stuck throttle can make this impossible.
The welding and construction of these scooters is often substandard. A number of these scooters experience stem collapses in the middle of a ride. This can throw a rider off and cause traumatic injuries.
Victims of scooter accidents may feel overwhelmed. Traumatic brain injuries and bone fractures are very common. These can put a person out of work for months or years and lead to high medical bills. A Los Angeles scooter accident attorney may be able to advance the costs of all of your medical bills and get you financial compensation if you’ve been involved in a scooter accident.
Liability In Scooter Accidents
Depending on the facts of the case, there are a number of potential entities that could face civil liability for the tragic accident that injured Liam ‘Doug’ O’Connell. Most Los Angeles scooter accidents will involve some amount of negligence on (1) other drivers, (2) scooter manufacturers or (3) the city of Los Angeles.
Drivers have a common law responsibility to operate their vehicles in a reasonably safe manner and to take steps to avoid hitting pedestrians. Often times this doesn’t happen. Drivers will speed or become distracted and may not see a scooter rider who typically have smaller profiles. Pedestrians then become the victims of this negligence. A pedestrian or scooter rider that is injured due to this negligence will have the right to file a bodily injury claim against the negligent driver’s insurance.
Scooter manufacturers have a responsibility to design their vehicles so that they are safe for public use. But a number of defective scooters cause riders to be seriously injured every year. Brakes fail, throttles stick and the stems on the machines collapse. Scooter accident victims may be able to file a product liability claim if this happens. Product liability claims typically are made under one of three categories (a) design defects, (b) manufacturing defects and (3) failure to warn. A personal injury attorney can examine your scooter for any potential defects that may have contributed to the crash.
A city may also potentially face liability for a scooter accident. Cities have a responsibility to maintain roads in a reasonably safe condition. According to California Government Code 835, “Except as provided by statute, a public entity is liable for injury caused by a dangerous condition of its property if the plaintiff establishes that the property was in a dangerous condition at the time of the injury, that the injury was proximately caused by the dangerous condition, that the dangerous condition created a reasonably foreseeable risk of the kind of injury which was incurred.” For example, a pothole in the road, uneven paving or debris can cause a scooter rider to be thrown off and seriously injured. There are some roads in Los Angeles that look like they came from a third world country. These roads can be perilous for scooter riders and drivers as well.
A personal injury attorney can evaluate the specific facts of your case and let you know if you have a claim that can be pursued. Cities and scooter manufacturers will work hard to deny liability after an accident. An attorney can fight them for you and make sure you are well taken care of.
