Hit-And-Run Truck Accident Reported: Javier Ocegueda Died In Motorcycle Accident With Big Rig Truck After Hit-And-Run Crash In South Los Angeles on the Harbor 110 Freeway
LOS ANGELES, CALIFORNIA (October 16, 2018) The Los Angeles Coroner’s office has identified a 25-year-old man who died in a truck accident on the 110 Harbor Freeway as Javier Ocegueda.
Los Angeles authorities are saying that a white box truck hit Javier Ocegueda and threw him off his motorcycle onto the pavement. The driver of the white box truck did not stop after the accident and police are still trying to locate him.
The motorcycle accident was first reported on Sunday at 3:04 a.m. by Manchester Avenue. Javier Ocegueda was riding a 2010 Suzuki GRX north on the freeway. Police believe that the victim was struck by several other vehicles after being thrown off his bike.
Firefighters and paramedics rushed to the scene of the collision in order to treat the victim. But he was later pronounced dead at the scene.
Anyone that may have seen what happened should contact the California Highway Patrol at (213) 744-2331.
Criminal Penalties For Hit And Run Collisions
In California, leaving the scene of a car accident that causes bodily injury is a felony. It doesn’t matter whether you hit a pedestrian or another car. Most states impose fines for drivers that commit felony hit-and-runs from $5,000 to $20,000. Depending on the facts of a particular case, a number of states punish felony hit-and-runs by up to 15 years in prison. It’s simply never a good idea to leave the scene of an accident. Drivers that cause accidents should remain at the scene and dial 911. This can mean the difference between another motorist living or dying. In addition to criminal penalties a driver may also face civil liability if they injure another motorist in a hit and run collision.
Civil Liability For Hit And Run Collisions
Truck drivers have a common law duty to drive in a reasonably safe manner and take steps to avoid accidents. Unfortunately, a number of accidents happen every year when truck drivers are being inattentive. Unlike smaller vehicles trucks have unusually large blind spots. Motorcyclists are often unseen because a driver fails to check their blind spots. Hit-and-run accidents typically follow two different patterns. Either a truck driver caused an accident and knowingly decided to take off. Or, a truck driver hit another motorist – didn’t realize it – and kept going. If it’s the former that is typically fairly strong evidence that the driver was not paying attention. If a truck driver was working at the time of the accident the company they work for may bear vicarious liability. Victims of truck accidents or their family may have the ability to file a claim for damages in order to be compensated for lost wages, medical bills and pain and suffering.
