Los Angeles police officials are saying that the victim was attempting to flag down the bus at the time of the accident. For reasons that remain under investigation, she was struck and knocked down by the bus.
The bus driver remained at the scene and cooperated with authorities. Wilshire Boulevard was closed for several hours as authorities continued to investigate.
The accident happened near a bus stop.
Liability In Bus Accidents
Bus companies are held to a very high standard when it comes to vehicle safety. In short, buses are common carriers and their drivers are expected to use a high degree of vigilance in order to avoid accidents. According to the Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers [or property].”
Many pedestrian accidents occur when bus drivers are distracted or fatigued. Another major safety concern with buses is their unusually large blind spots. It’s easy for a pedestrian to be obscured in the large blind spots. There are a number of steps that victims of bus accidents should take following an accident in order to preserve their rights:
- Victims that are injured should seek medical treatment. A doctor can help document the full extent of your injuries.
- Take any pictures that you can of the accident scene. The position of the bus and the location of other vehicles may be relevant later on.
- Call the police so that they can thoroughly investigate the accident and help preserve evidence.
- Seek the legal counsel of a bus accident attorney. An attorney can make sure your rights are being protected and fight bus companies that try to deny liability.
The family of a victim that dies in a bus accident may be able to seek justice under California Code of Civil Procedure 377.60. Damages in a wrongful death claim can include compensation for lost wages, loss of love, funeral costs and pain and suffering. In situations where a bus drivers conduct was particularly egregious punitive damages may apply. A bus accident attorney can investigate your claim free of charge and let you know what your options are.
