Truck Driver Fatigue As A Factor In Accidents

The National Transportation and Safety Board (NTSB) has estimated that fatigue is a contributing factor in around 30-40% of commercial truck accidents. Truck drivers are placed under an enormous amount of pressure to transport goods quickly and efficiently. This can often have lethal consequences. Truck drivers are not allowed to work more than 60 hours per week, but these rules are not always obeyed. There are a number of ways that both individuals and companies can work towards helping reduce truck driver fatigue.

  • Truck drivers can help reduce fatigue by eating healthy and getting regular exercise. It’s important to have a routine when it comes to sleep and to avoid distractions. Often times, we can become fixated on our cell phones and keep our minds active long after we should normally be asleep.

  • There is actually a lot of technology that can also help truck drivers stay alert. For example, there are devices that can be mounted on the inside of trucks that measure eyelid movement. Truck drivers will be alerted if they close their eyes while driving.

  • Finally, trucking companies should give drivers adequate time to take breaks. Delivery schedules should allow enough time for truck drivers to be able to take naps.

If a truck driver gets fatigued while doing their routes and causes an accident the company that they work for may face vicarious liability. A truck accident attorney can investigate what caused an accident and let you know what your rights are.

Liability In Semi Truck Accidents Involving Pedestrians

There are a number of factors that police will want to look into as they investigate the fatal truck accident that killed Francisco Guzman Carranza. Trucks can weigh as much as 80,000 lbs when they are fully loaded. Fatigue can therefore result in catastrophic accidents. A truck’s driver may be held liable for an accident if they were drowsy and neglectful. But a truck driver’s insurance policy may not be sufficient to cover catastrophic injuries or death. It will typically be beneficial for the plaintiff to file a claim against the truck driver’s employer as well. A victim’s family will be able to file a wrongful death claim against the company that hired the driver. The defendant will typically be responsible for the plaintiff’s lost wages, medical bills and pain and suffering.
