Liability In DUI Car Accidents
According to Mother’s Against Drunk Driving (MADD), “In 2013, 9.9 million people (3.8% of the population) reported driving under the influence of illicit drugs. This was highest among 18-25 year olds, where 10.6% reported driving under the influence of illicit drugs.” Here are just a few of the ways that even a moderate amount of alcohol can affect a person’s ability to drive.
- Slow reaction time
- Lack of coordination
- Reduce concentration
- Decrease vision
- Inhibited judgement
It is a felony to cause an accident while under the influence of alcohol or drugs. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Any person that causes an accident while intoxicated may face criminal as well as civil liability.
Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many victims of car accidents may not even realize the full extent of their injuries until weeks or months later. A car accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
