Liability In Bus Accidents
Bus drivers are held to a very high standard when it comes to operating their vehicle safely. According to Judicial Council of California Civil Jury Instructions, “Common carriers must carry passengers [or property] safely. Common carriers must use the highest care and the vigilance of a very cautious person. They must do all that human care, vigilance, and foresight reasonably can do under the circumstances to avoid harm to passengers[or property].”
Buses tend to have very large blind spots and if a driver is not careful they could easily end up hitting a pedestrian. The family of a victim that dies in a bus accident may be able to seek justice by filing a claim under California Code of Civil Procedure 377.60. A bus accident attorney can investigate your claim free of charge and let you know if a bus driver violated any safety rules prior to an accident.
