Los Alamos Bus Accident: Intoxicated Bus Driver Arrested Following Rollover Accident On Highway 101

LOS ALAMOS, CALIFORNIA (February 11, 2019) – A bus carrying 24 people overturned on Highway 101 into a ravine leaving 7 people injured.

California Highway Patrol are saying that the accident took place around 5:45 a.m. not far from Alisos Canyon Road. Paramedics rushed to the scene of the accident in order to take the injured riders to the hospital.

The bus driver allowed the vehicle to drift off the freeway and down the embankment. Authorities later arrested the bus driver on suspicion of DUI.

Daniel Carman was one of the passengers on the bus at the time of the accident. According to Daniel, “I was asleep, honestly. I woke up after I felt movement and I was sideways.”

Authorities stayed at the scene of the Los Alamos Bus Accident for several hours in order to investigate.

Liability In Bus Accidents

Buses are considered “common carriers” under the law. Drivers must undergo extensive training and use extra caution to avoid accidents. According to the Judicial Council of California Civil Jury Instructions, “While a common carrier does not guarantee the safety of its passengers[or property that it transports], it must use reasonable skill to provide everything necessary for safe transportation, in view of the transportation used and the practical operation of the business.”

What a number of people don’t realize is that most state and FMCSA regulations for commercial drivers and alcohol are fairly strict. A blood-alcohol concentration of 0.04 is considered intoxicated for commercial drivers. This is in comparison to the 0.08 blood alcohol concentration limit for everyday commuters. Bus drivers that choose to get intoxicated and cause an accident may face civil liability as well as criminal liability.

Victims of bus accidents are able to recover damages by filing a bodily injury claim. Damages in a personal injury claim will include compensation for lost wages, medical bills and pain and suffering. A bus accident attorney can investigate your case free of charge and may be able to get you financial compensation for your injuries.
