Rosalva Fierro Long Beach: Rosalva Fierro Died In Car Accident By Del Amo Boulevard and Orange Avenue

LONG BEACH, CALIFORNIA (June 9, 2019) – A 49-year-old woman identified as Rosalva Fierro has tragically died in a car accident after she was hit by a pickup truck that was trying to beat a red light near the intersection of Del Amo Boulevard and Orange Avenue.

Long Beach police are saying that the accident occurred around 10:30 p.m. Police think the driver of a 2018 Nissan Titan was trying to beat a red lead when it broadsided a 2003 GMC Yukon.

Paramedics rushed to the scene in order to help Rosalva Fierro. Police took a blood sample of the driver of the pickup truck in order to determine if he was intoxicated.

Rosalva Fierro was later pronounced dead due to her injuries. She was described by her family as a beloved mother and wife who was returning home from a church service.

Liability In Car Accidents

The vast majority of car accidents are caused either by drivers that are speeding, distracted or under the influence. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” When a driver chooses to operate their vehicle under the influence they may face civil liability.

What many drivers do not realize is that alcohol is not the the only intoxicant that can affect a person’s ability to drive safely. For example, there are a number of over the counter medications that can seriously impair a driver. A study in JAMA Neurology has shown that “Anticholinergic drugs found in many commonly used over-the-counter medicines, such as night time cold remedies, are associated with brain scan changes linked to cognitive impairment.”

The family of any victim that dies in a car accident may have legal recourse through California Code of Civil Procedure 377.60. Damages in a wrongful death claim can help a victim’s family with funeral costs, medical bills, lost wages and emotional trauma. A wrongful death attorney can examine all of the facts of your case and let you know what your options are. There are, however, statute of limitations for pursuing civil claims, so it’s important to be proactive.
