Drunk Driving Statistics
According to the NHTSA, “Every day, almost 30 people in the United States die in drunk-driving crashes—that’s one person every 48 minutes in 2017. These deaths have fallen by a third in the last three decades; however, drunk-driving crashes claim more than 10,000 lives per year.” Nearly one out of every three people will be involved in a DUI accident at some point in their lives. There are negative ways that alcohol can impair driving:
- Alcohol can lead to blackouts that put the driver and everyone else on the road at risk.
- Even at low doses alcohol can impair a person’s decision making ability.
- Alcohol lowers a persons inhibitions and increases the likelihood of reckless behavior.
Unfortunately, drivers will often operate their vehicle under the influence dozens of times before they are finally caught. Pedestrians injured by drunk drivers often suffer very serious injuries. This may include broken bones, whiplash, head injuries, pelvic injuries, spinal injuries and internal trauma. Depending on the facts of any case, there may be numerous forms of liability in any DUI accident.
Liability In DUI Accidents
Taxi drivers are considered “common carriers” under the law in California. As such, they are held to a very high standard in terms of safety. According to Acostav. Southern California Rapid Transit Dist., “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a verycautious person towards their passengers. Such carriers are responsible for any, even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.”
It is illegal for any driver to operate their vehicle under the influence of alcohol. Commercial drivers including taxi drivers are held to a higher standard than the general population. According to California Vehicle Code 23152 (d), “It is unlawful for a person who has 0.04 percent or more, by weight, of alcohol in his or her blood to drive a commercial motor vehicle, as defined in Section 15210.” Normal drivers must not exceed a BAC of 0.08. But the truth is that a BAC of even lower than 0.04 can impair a person’s driving.
If a taxi driver causes an accident while under the influence they or their employer could face civil liability. Any person that is injured in a car accident may have the ability to recover damages through a bodily injury claim. This can include money for lost wages, medical bills and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
