LA MESA, CALIFORNIA (October 21, 2018) A motorcyclist was injured after he crashed into a garbage can laying in the middle of State Route 94 in La Mesa on Sunday Afternoon.

California Highway Patrol are saying that the motorcycle accident took place around 1:15 p.m. near Massachusetts Avenue on the SR 94 Freeway. The motorcycle rider was thrown from his bike onto the right hand shoulder on the highway.

A caller told the La Mesa police about the garbage can laying in the middle of the road a few moments before the accident. A driver that witnessed the crash was able to move the motorcycle off the highway so that no one would hit it.

The motorcyclists sustained a broken leg and was transported to a local hospital in order to be treated for his injuries. There is no word yet on who may own the trash can involved in the accident.

Accidents Involving Debris In The Roadway

The accident that happened on the La Mesa freeway that left a motorcyclist with a broken leg is far from an anomaly. It has been estimated that debris in the roadway contributes to over 200,000 crashes every year. Around 39,000 people are injured and another 500 end up dying. Motorcyclists are the worst impacted because of their lack of protection. A large portion of the debris is from previous accidents. Shredded tires and other vehicle parts may not get cleaned up after a collision. Appliances and other items also end up on the road if they aren’t properly secured. These can be lethal hazards for motorcyclists and should be cleaned up as soon as possible. Depending on the facts of the case, the owner of a trash can laying in the middle of the road may face civil liability if the item injures or kills a driver.

Liability In Accidents Involving Debris In The Roadway

Drivers have a common law responsibility to operate their vehicles in a reasonably safe manner. This includes taking steps to make sure that cargo is properly secured. It’s important that drivers take the time to learn how to do this or to have a professional do it for them.

If a driver fails to secure a load and it comes off and causes an accident they will typically be held responsible for that. If a company is transporting an item and a trash can comes off they could face liability as well. Victims will have the ability to file a personal injury claim for damages including lost wages, medical bills and pain and suffering. A motorcycle accident attorney can evaluate your case and let you know if you have a claim that can be pursued.
