HEMET, CALIFORNIA (September 27, 2018) A 29-year-old pregnant mother of 3 identified as Krystil Kincaid was tragically killed in a DUI head-on collision after she was hit by a BMW driven by professional boxer Marcos Forestal.

Krystil Kincaid was on speakerphone with her husband when Marcos Forestal’s BMW hit her Chrysler minivan. The car accident left Krystil Kincaid’s legs pinned to the dashboard preventing her from leaving the vehicle.

Firefighters had to use the jaws of life in order to free her. She was airlifted to a local trauma center in critical condition. But she and her unborn child both died.

Hemet police are saying that Marcos Forestal was allegedly speeding when the deadly head-on accident took place. A Go Fund Me page has been set up in order to help the family of Krystil Kincaid.

Forestal is currently facing charges of gross vehicular manslaughter while intoxicated. An investigation into the accident remains ongoing at this time.

Car Accident Causes and Statistics

Every year around 35,000 people are killed in car accidents according to the Institute of Insurance Safety. Males were more than twice as likely to be involved in fatal accidents as females. Speeding has remained the number one cause of car accidents. People regularly overestimate their ability to control their vehicle at high speeds. Here are just a few of the other contributing factors that lead to accidents every year:

  • Drunk Driving: The Centers for Disease control has estimated that 28 people die everyday due to drunk driving. People think that they can drive safely after a few drinks, but this is absolutely not the case. Even moderate amounts of alcohol can seriously alter a person’s reaction time.

  • Distractions: The National Highway Safety Administration lists 5 major distractions that contribute to accidents. Talking on cell phones, texting, eating, talking to passengers and adjusting the radio contribute to around 16% of accidents every year.

  • Weather: Road conditions caused by bad weather can be extremely dangerous. This is especially true when drivers are unused to driving in rain, snow, fog or hail. A responsible driver must slow down and drive according to the prevailing conditions of the road. Driving the speed limit during a rainstorm could very well be reckless.

  • Fatigue: Driver fatigue can be just as dangerous as drunk driving. Drivers that are tired may even fall asleep behind the wheel. This is an especially big problem for truck drivers that are often forced to work long hours with few breaks.

Car accidents can have devastating consequences for an individual and even a family. But there are numerous laws that can help protect a victim’s rights following a collision. Victims of car accidents may have the ability to file a personal injury claim. A Los Angeles car accident attorney can examine the facts of your case and let you know what your rights are.

Liability In Car Accidents

Authorities will typically use common law concepts of negligence in order to determine liability in a car accident. Negligence is any action or lack thereof which causes injury or death to another person. When an individual’s behavior deviates from that of a reasonable person in a similar circumstance those actions would typically be considered negligent.

For example, a reasonable person would not become intoxicated and speed down the road. Driving under the influence is known to be dangerous as is speeding. Negligent drivers will typically face civil liability for their actions. Grossly negligent drivers may even face criminal charges. Victims of a car accident or their family may be entitled to compensation for lost wages, medical bills and pain and suffering.
