Dangerous Roads In California

Driving is an essential function in modern life. We need to drive to go to work, to school and live our daily lives. Accidents occur mostly due to driver error, but defects within a roadway can also contribute to a crash. These may include:

  • Potholes

  • Uneven paving

  • Bumps in the roadway

  • Unguarded fixed objects

  • Lack of street signs

  • Debris in the roadway

  • Lack of street lights

The majority of dangerous roads and intersections in California are concentrated in Orange County, Los Angeles, San Diego and the Bay Area. Depending on the facts of any case, a city or municipality might be liable if a defect in the road contributed to an accident.

Liability In Accidents Caused By A Defect In The Road

Cities and state agencies are the entities responsible for taking care of the roads. Broadly speaking there are three major areas where these agencies should step in to make sure that the roads are safe:

  • Road Design: The way that a road is built from the beginning is very important. There are safety guidelines about how wide roads should be, where street lights should be installed and numerous other features.

  • Road Maintenance: Cars, trucks and other vehicles naturally wear roads down over time. No road can last forever. This is why it’s important that periodic maintenance be done to make sure that the road doesn’t become dangerous.

  • Road Repair: Parts of a road or guardrails can become damaged after weather or an accident. It is critical that these features be repaired in a timely manner. For example, a damaged guardrail can malfunction and spear a vehicle or cause it to flip over.

Victims of car accidents can be left with traumatic injuries including brain injuries and spinal cord injuries. When dealing with accidents this severe it’s important to have an expert on your side advocating for your rights. A Los Angeles spinal cord injury lawyer can examine the facts of your case and let you know if you have a claim that can be pursued.
