What To Do After A Car Accident
There are over six million people involved in car accidents every year in the United States. These accidents result in 35,000 deaths annually and leave many more seriously injured. If you are involved in a car accident there are a number of steps that you should take in order to preserve your rights:
Stop: It is a felony to leave the scene of a car accident that causes great bodily injury. Be sure to stop after an accident, even if the damage is minor.
Police: Call the police and make sure that a report of the accident is taken. Tell the investigators exactly what happened.
Pictures: Take pictures of the scene and any injuries that you sustain.
Information: Be sure to exchange information with the other driver involved in the accident. Get the name address and telephone number of all people in the car including passengers.
Report: Let your insurance company know about the accident as soon as possible.
Treatment: Get medical treatment as soon as possible. If you wait to seek treatment or go untreated an insurance company will use this as evidence that you weren’t injured that badly.
Preserve your rights: Don’t talk to any insurance adjusters after an accident and seek the legal advice of an attorney. A car accident attorney can help you with treatment and get you compensation after an accident.
Insurance companies will work hard to deny liability after an accident. If your accident was caused by a design defect with a road, you may have the ability to file a municipal negligence claim against the city in order to receive compensation.
Liability In Car Accidents Involving Road Design Defects
It has been estimated that nearly 94% of all car accidents involved some amount of human error. But in a number of circumstances, defects in the roadway like potholes or uneven paving can lead to serious accidents. Under California law cities have a responsibility to keep roads and highways reasonably safe. Cities may face civil liability if a dangerous condition on a roadway leads to an accident:
“[A] public entity may be liable for a dangerous condition of public property even when the immediate cause of a plaintiff’s injury is a third party’s negligent or illegal act (such as a motorist’s negligent driving), if some physical characteristic of the property exposes its users to increased danger from third party negligence or criminality. Public entity liability lies under section 835 when some feature of the property increased or intensified the danger to users from third party conduct.” (Castro v. City of Thousand Oaks (2015) 239 Cal.App.4th 1451, 1457−1458 [192 Cal.Rptr.3d 376], internal citation omitted.)
When there is a history of accidents at a given location this puts the city on notice that steps should be taken to rectify the problem. Unfortunately, this doesn’t always happen. Any person that is injured in a single vehicle accident caused by a defect in the roadway may be able to receive compensation for lost wages, medical bills and pain and suffering
