Liability In Car Accidents
According to the RMIIA, “In 2016 there were 6,296,000 police-reported motor vehicle traffic crashes; 37,461 people died and 2,443,000 people were injured. An average of 96 people died each day in motor vehicle crashes. One fatality every 15 seconds.” Those that manage to survive are often left with very serious injuries including:
- Psychological injuries / PTSD
- Broken bones
- Spinal cord injuries
- Head injuries
- Organ damage
The vast majority of car accidents are completely preventable. In fact, it has been estimated that nearly 94% of all accidents are due to human error. According to the FMCSA, Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” If drivers fail to yield the right of way to other drivers at intersections they will likely be held at fault.
According to California Vehicle Code 21804, “The driver of any vehicle about to enter or cross a highway from any public or private property, or from an alley, shall yield the right-of-way to all traffic, as defined in Section 620, approaching on the highway close enough to constitute an immediate hazard, and shall continue to yield the right-of-way to that traffic until he or she can proceed with reasonable safety.”
Any person that is injured in car accident while in a school van may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover medical bills, lost wages and pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they can take steps to make sure that your rights are being protected.
