Liability In Balcony Falls

Thousands of people are injured in balcony falls and collapses every year in the United States. All property owners are expected to keep their premises in a reasonably safe manner in order to prevent accidents. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” This includes making sure that apartment complexes are compliant with all relevant safety codes.

Falls tend to happen for a wide variety of different reasons. For example, if a railing is below code requirements a person could trip and fall over. Loose railing or rusted bolts are another big problem. Property owners should do periodic maintenance on balconies in order to make sure that they are safe. When a property owner fails to take reasonable steps to keep their property safe they could face civil liability in the event of an accident. Any person that is injured may be able to collect damages through a personal injury claim. Damages can include money for lost wages, medical bills and pain and suffering. A premises liability attorney can examine all of the facts of your case and let you know what your options are.
