Hesperia police are saying that the accident took place around 11:30 p.m. A neighbor was driving home when he came across the victim who was trapped underneath his truck with the engine still running.
Firefighters and police arrived to help the victim, but he was later pronounced dead at the scene. There is an ongoing investigation into what may have caused the accident.
Liability In Car Accidents
Companies that manufacture jacks for cars have a legal responsibility to make sure that those jacks are reasonably safe. When a company fails to create a jack that is reasonably safe or it fails mid-use they can be liable for any resulting accident. Generally speaking, there are three broad categories under which a device like a jack may be defective:
- Design Defects: “Design defects are inherent, as they exist before the product is manufactured.”
- Manufacturing Defects: “Manufacturing defects occur during the construction or production of the item.”
- Marketing Defects: “Defects in marketing deal with improper instructions and failures to warn consumers of latent dangers in the product.”
The family of a victim that died in an accident with a defective jack may be able to seek justice through California’s Code of Civil Procedure 377.60. A wrongful death attorney can examine the facts of your case and let you know what your legal options are. It’s important to make sure that evidence is preserved after an accident. An attorney can make sure that your rights are being protected and that evidence in a particular accident is kept safe.
