Liability In Hotel / Motel Fires
All property owners have a legal responsibility to maintain their premises in a reasonably safe manner. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.” Property owners should take some of the following measures to protect guests from fires:
- Electrical work should be done competently. A number of fires are started due to faulty wiring.
- Smoke detectors should be installed throughout the property in order to warn about fires.
- Doors, hallways and stairs should be unobstructed so that guests are able to flee in the event of a fire.
Any person that is injured in a fire at a Motel 6 have legal recourse through a bodily injury claim. Damages in a civil claim claim may include money for lost wages, medical bills and pain and suffering. A premises liability attorney can examine all of the facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with being able to file a claim, so it’s important to act quickly.
