Healdsburg Motorcycle Accident With Pure Luxury Bus: Bus Accident Injured Two Motorcyclists On Dry Creek Road
HEALDSBURG, CALIFORNIA (June 24, 2019) – A male motorcyclist and his female passenger were both seriously injured in a bus accident on Dry Creek Road in Sonoma County northwest of Healdsburg.
California Highway Patrol are saying that they got a call around 3:00 p.m. that a Pure Luxury Bus collided with a motorcycle by the intersection of Dutcher Creek Road and Dry Creek Road.
The man driving the motorcycle suffered major abdominal injuries in the crash and his female passenger sustained moderate injuries. Both victims were taken to Memorial Hospital in Santa Rosa.
The driver of the bus declined to comment about what happened but remained at the scene. Police are still saying it’s too early to attribute fault for the crash.
Pure Luxury Transportation offers visitors wine tours in the area. There is an ongoing investigation into the cause of the accident at this time.
Liability In Bus Accidents
Bus companies are considered “common carriers” under the law. As such, they are held to a very high standard in terms of safety. According to Acosta v. Southern California Rapid Transit Dist., “Common carriers bind themselves to carry safely those whom they take into their vehicles, and owe both a duty of utmost care and the vigilance of a very cautious person towards their passengers. Such carriers are responsible for any, even the slightest, negligence and are required to do all that human care, vigilance, and foresight reasonably can do under all the circumstances.” One of the factors that make buses particularly dangerous for motorcyclists is that they have large blind spots:
As you can see from the diagram, buses have extraordinarily limited visibility to their sides. It’s easy for a motorcyclist to disappear. This is why it’s so important that bus drivers use their mirrors and check their blind spots. But blind spots aren’t the only danger that motorcyclists must deal with. Here are just a few of the common factors that contribute to bus accidents:
- Bus driver fatigue
- Bad weather
- Left turns
- Bus fires
- Bus company negligence
If a bus driver was negligent and caused an accident the company that they work for could potentially face liability. Generally speaking, companies are liable for the negligent conduct of their employees. A bus company could also contribute to an accident if they fail to hire competent drivers or fail to give their drivers adequate training. Unfortunately, victims of bus accidents are often left with catastrophic injuries including:
- Broken bones
- Back injuries
- Spinal cord injuries
- Abdominal injuries
- Traumatic brain injuries
Not every injury from a bus accident is entirely physical. A large number of people who survive bus accidents report having PTSD. Victims may experience recurring and unwanted thoughts of the event. There are a number of laws designed to protect victims rights. Any person that is injured in a bus accident could recover damages through a bodily injury claim. Damages may include money for lost wages, medical bills and pain and suffering. A bus accident attorney can investigate your claim free of cost and let you know what your options are.
