Liability In DUI Accidents

According to the Centers For Disease Control, “Every day, 29 people in the United States die in motor vehicle crashes that involve an alcohol-impaired driver. This is one death every 50 minutes. The annual cost of alcohol-related crashes totals more than $44 billion.” People who drink and drive typically do so dozens of times before they are caught or involved in an accident. Alcohol impairs many cognitive functions including:

  • Reaction Time
  • Vision
  • Tracking
  • Concentration
  • Comprehension
  • Coordination

It is illegal to operate a motor vehicle with a (BAC) of 0.08 or higher. According to California Vehicle Code 23152,  “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.” Commercial drivers are held to an even higher standard. Commercial drivers are considered legally intoxicated with a (BAC) of 0.04 or higher.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim may include money for lost wages, medical bills as well as pain and suffering. A car accident attorney can examine all of the facts of your case and let you know what your legal rights are. There are statute of limitations associated with being able to file a claim, so it’s important to be proactive.
