14-Year-Old Boy Seriously Injured In Car Accident As He Was Walking To School Near Garden Grove Boulevard and Nelson Street
GARDEN GROVE, CALIFORNIA (March 7, 2019) – A 14-year-old boy was critically injured when he was hit by a vehicle near Garden Grove Boulevard and Nelson Street.
Police are saying that the boy was hit by the vehicle as he was walking to school sometime around 8:50 a.m. The young boy was taken to the hospital with numerous injuries including:
- A broken jaw
- A skull fracture
- A broken nose
The driver that hit the boy was making a left hand turn at the time of the accident. It remains unclear if the driver that hit the pedestrian will face any charges.
Liability In Left Turn Accidents
Drivers are supposed to slow down in school zones. But far too often drivers are not paying attention as they make turns. If a driver makes a left turn and hits a pedestrian they will likely be held at fault for the accident. According to the California Vehicle Code 21801, “The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.”
In addition to driver liability there may also be liability on the part of a city for a pedestrian accident. If, for example, an intersection lacked basic safety features like stop signs that could create a hazard. Likewise, foliage that blocks street signs is another hazard that could create liability for a city. Following an accident, it’s important to seek medical treatment and to get your injuries documented.
The lifetime costs associated with treating a brain injury can range anywhere from several hundred thousand to several million.
