Galt officials are the the accident took place at Cal-Waste Recovery Systems on Enterprise Way around 5:00 a.m. A person driving a loaded apparently didn’t see the victim and hit them as they were backing up.

Firefighters and paramedics rushed to the scene in order to help the victim, but they later died due to their injuries. The identity of the victim that died will be released when their next of kin has bee notified.

Cal/OSHA and Galt officials are conducting an investigation into the accident at Cal-Waste Recovery Systems.

Liability In workplace Accidents

Companies must do everything in their power to help ensure that their workers are safe. This includes but is not limited to:

  • Maintaining premises in a safe condition.
  • Providing workers with necessary safety gear.
  • Providing workers with adequate training.
  • Removing potential hazards from a site.

When a worker is injured on the job, their employer has a legal obligation to support them. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This also includes providing death benefits to the family members of a deceased worker.

What many workers don’t realize is that the worker’s compensation system may not be their only recourse. An injured worker or their family may be able to seek damages through a third party liability claim. If, for example, a worker or entity separate from a victim’s employer was responsible for the accident they could be held liable. Potential claimants in a wrongful death case could include a worker’s:

  • Spouse
  • Children
  • Mother
  • Father
  • Sister
  • Brother

There is simply no reason why a truck should ever back into anyone. Workers are supposed to be trained to communicate with one another. If a truck driver cannot see what is behind them, then a spotter should get out of the truck and help. In many situations, truck drivers are simply going about their job too fast or are otherwise distracted.

It’s always wise to have any workplace accident examined by a skilled wrongful death attorney. An attorney can investigate your case free of cost and let you know if there were any potential instances of third-party negligence. There are, however, statute of limitations associated with work claims. It is therefore important to act quickly.
