Authorities are saying that the intersection were the accident took place can be very tricky. There are only two stops signs at the intersection for the traffic on Kearny.
An investigation into the cause of the accident remains ongoing at this time.
Liability In Truck Accidents
Truck drivers have a legal responsibility to scan the road ahead of them and do their best to avoid accidents. Unfortunately, this does not always happen. A number of truck accidents take place every year when truck drivers are fatigued or otherwise distracted. But driver negligence isn’t always entirely to blame for an accident. A number of collisions take place every year due to dangerous intersections.
According to California Government Code 830.8, “A public entity may be liable for accidents approximately caused by its failure to provide a signal, sign, marking or device to warn of a dangerous condition which endangers the safe movement of traffic and which would not be reasonably apparent to, and would not have been anticipated by, a person exercising due care.” If a government entity is given constructive notice of a dangerous condition and they fail to act that is a huge problem.
Any person that is injured in an accident with a dangerous intersection may be able to file a municipal negligence claim. Damages in a personal injury claim can include money for lost wages, medical bills and pain and suffering. A truck accident attorney can examine all of the facts of your case and let you know what your options are.
