A man called in to the police department saying that his BMW had been stolen from an Applebees. But when they police looked into the call records, they discovered that the call was made 17 miles away from Applebees.
The driver of the BMW told police he hit an object in the roadway, but his female passenger told police they knew they hit a person.

Liability In DUI Car Accidents
Driver’s have a responsibility to operate their vehicles in a reasonably safe manner and take steps to avoid accidents. Moreover, driver’s should abstain from drinking alcohol or taking any substance that could impair their ability to drive safely. According to California Vehicle Code 23152, “(a) It is unlawful for a person who is under the influence of any alcoholic beverage to drive a vehicle. (b) It is unlawful for a person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.”
What many people don’t realize is that they can be arrested and charged with DUI even if they only had a legally prescribed medication in their system. Drivers have a responsibility to check with their doctors to make sure that their prescriptions won’t impede their ability to operate a motor vehicle. If a drunk driver does cause an accident they should remain at the scene and try to get aid to the victim. Leaving the scene of a car accident that causes great bodily injury or death is a felony offense.
The family of any person that dies due to the negligence of a drunk driver may be able to seek justice under California’s Code of Civil Procedure 377.60. Negligent drivers will be responsible for financial damages to the victim’s family including lost wages, funeral costs and pain and suffering. A wrongful death attorney can advocate on your behalf and hold a criminal DUI driver accountable for their actions. There are statute of limitations associated with being able to file a claim, so it’s important to act quickly.
