Liability In Hit-And-Run Accidents
According to data from the NHTSA, “Alcohol-impaired driving fatalities accounted for 29% of the total vehicle traffic fatalities in 2017. Between 1991 and 2017, the rate of drunk driving fatalities per 100,000 population has decreased 46% nationally, and 68% among those under 21. These statistics and others are positive indicators of the gains being made to fight drunk driving.” Drivers that choose to take controlled substances before driving will likely face civil as well as criminal liability for their actions.
It is a felony to flee the scene of an accident that results in bodily injury. According to California Vehicle Code 20001, “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident and shall fulfill the requirements of Sections 20003 and 20004.”
The family of any victim that died due to the negligence of an intoxicated driver may be able to hold them accountable through a civil claim. Damages in a civil claim can help cover lost wages, funeral expenses and emotional trauma. Potential claimants in a civil matter may include a victim’s parents, siblings, spouse and children. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
