Angel Barajas Fresno: 31-Year-Old Angel Barajas and 66 Year-Old Arnold Torres Died After Being Crushed By Hydraulic Arm of Almond Shaker
FRESNO, CALIFORNIA (January 8, 2018) – Two Vista Verde Ranch workers identified as Angel Barajas and Arnold Torres tragically died after the hydraulic arm of an almond shaker crushed them as they were trying to repair it.
Fresno officers arrived at the scene of the accident and came across both workers who were critically injured. The hose to the hydraulic arm was disconnected causing it to fall on top of the workers.
Cal/OSHA believe that the hydraulic arm may have malfunctioned prior to the accident. A full investigation remains ongoing at this time.
Liability In Workplace Accidents
Workers in California are protected by a number of laws. If a worker dies on the job their family will typically have the ability to file a worker’s compensation claim. In addition to workers compensation, a third party liability claim may also be possible if an entity separate from the worker’s employer caused the accident. For example, a third party liability claim may be possible if a machine malfunctioned and injured a worker.
Companies have a responsibility to design and manufacture consumer products that are reasonably safe to use. When a machine could become dangerous through its use, consumers must be given fair warning of those dangers which are not obvious. A wrongful death attorney can examine the specific facts of your case and let you know if you have a claim that can be pursued.
