FRESNO, CALIFORNIA (July 17, 2019) – A 53-year-old worker identified as Alfredo Arce Razo has tragically died in an accident at Foster Farm after being hit in the head by a large refrigerator.

Firefighters and paramedics rushed to the scene in order to help Alfredo Arce Razo. Despite life-saving efforts the victim died shortly after paramedics arrived.

Sherri Alcorn described Alfredo Arce Razo as an incredibly hard worker who would always go above and beyond to provide for his wife and daughter.

Common Causes of Worker Injury An Death

Nearly 4,000 workers are killed every year in the United States. According to the National Safety Council, “Every 7 seconds, a worker is injured on the job. These numbers are staggering, and the worst part is that each one is preventable. Taking preventative action can spare workers needless pain and suffering.” As it turns out, the vast majority of accidents fall into one of four categories. OSHA has nicknamed these the “fatal four.”

  • Falls 39.2%
  • Struck by object 8.2%
  • Electrocutions 7.3%
  • Caught-in/between 5.1%

Most of these accidents are completely preventable. They tend to occur when safety regulations are not being following. For example, workers must wear hard hats in construction zones an be given fall arrest systems when they are at elevated heights. Depending on the facts of any case, there may be numerous sources after a workplace accident.

Liability In Workplace Accidents

When a worker is injured or killed in California their employer has a responsibility to provide them or their family with benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” It’s important to make sure that all of the proper paperwork is filled out in a timely manner. What many people don’t realize is that worker’s compensation may not be their only source of recovery.

If a contractor was killed due to the negligence of a company separate from their employer that company could face civil liability. Companies have a legal responsibility to keep their premises in a reasonably safe manner and take steps to prevent accidents. According to the California Civil Code § 1714 subsection (a), “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”

The family of any victim that died in a workplace accident may have legal recourse through a wrongful death claim. Damages can help cover lost incomes to spouses, children and other dependents. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are. An attorney can investigate whether or not there was third party negligence in an accident. There are, however, statute of limitations associated with filing a claim, so it’s important to act quickly.
