Liability In Car Accidents When Drivers Hit Storefronts
Drivers running into storefronts may seem like a freak occurrence, but it is actually extraordinarily common. There are literally tens of thousands of similar accidents that happen every year in the United States. Most of these accidents involve elderly drivers who experience “pedal confusion.” In short, a driver mistakes the accelerator for the brakes and they can end up driving into a building. Older drivers are much more likely to experience pedal confusion than younger drivers. As we age, our senses diminish and this can have horrific results for drivers as well as pedestrians. Drivers that experience pedal confusion and cause an accident will typically face civil liability if someone is injured or killed.
In addition to driver negligence, a victim of a storefront collision may also have the ability to file a premises liability claim. In short, business owners have a responsibility to maintain their premises in a reasonably safe environment. This includes having safety features that could help prevent pedestrian accidents. Because storefront collisions are so common, there have been a number of measures designed to prevent them. A bollard post is a rigid concrete or steel structure that sticks up out of the ground. They are usually placed in areas where pedestrians walk and may be vulnerable to an accident.
Depending on the facts of any case, a property owner may face civil liability for failing to install bollard posts to prevent cars from entering a storefront. When there is a history of similar accidents at a property this should prompt the owners to take action. A victim may have the right to file a claim for damages including lost wages, medical bills and pain and suffering.
