Liability In Workplace Accidents
Companies in California have a legal responsibility to take measures to keep their workers safe. Safety must be taken seriously and enforced. Here are just a few of the measures that employers must follow:
- Employers must be aware of the hazards employees face on the job and train employees on safety procedures.
- Employers must correct hazardous conditions at a job site.
- Employers must comply with all Cal/OSHA safety standards.
- Employers must notify the nearest Cal/OSHA office of any serious injury or accident.
Employees that get injured on the job are protected by a number of laws. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This includes providing death benefits to a worker’s next of kin if they are killed.
What many worker’s don’t realize is that the worker’s compensation system may not be their only recourse. For example, if any entity separate from a worker’s employer was negligent and caused an accident they could be held liable through a third party claim. A wrongful death attorney can examine all of the unique facts of your case and let you know what your rights are.
