ESCONDIDO, CALIFORNIA (August 2, 2019) – A 40-year-old landscape worker identified as Noe Valle Cayetano tragically died in an accident while trimming palm trees at a vacation home along Neptune Place.
Escondido police are saying that the accident took place around 11:30 a.m. according to the San Diego County Medical Examiner’s Office. Noe Valle Cayetano was trimming palm trees when he fell nearly 50 feet.
Paramedics and firefighters rushed to the scene of the accident. Despite life-saving efforts Noe Valle Cayetano was later pronounced dead at the scene.
An investigation into the workplace death remains ongoing at this time.
Liability In Workplace Accidents
Companies that employ landscape workers have a legal responsibility to take measures to keep their workers safe. In the event of an accident they must provide a worker or their family with benefits. According to the California Department of Industrial Relations Workers Compensation Guidebook, “If you get hurt on the job, your employer is required by law to pay for workers’ compensation benefits.” This includes providing death benefits to the family of any worker that died.
What many workers and families don’t realize is that the worker’s compensation system may not be their only recourse after an accident. Depending on the facts of any case, a worker’s family may have recourse through a third party liability claim. A third party liability claim may be possible if an entity separate from a worker’s employer was responsible for an accident.
The family of a worker that died on the job may be able to seek justice through California Code of Civil Procedure 377.60. Damages can help cover funeral expenses, lost wages, medical bills and emotional trauma. A personal injury attorney can investigate all of the facts of your case and let you know what your legal options are. It’s important that evidence is preserved following an accident.
